Shipments and returns
DELIVERY OF GOODS
The delivery of goods in Portuguese territory is made by courier or postal service or the goods can be accepted by the Buyer at the local store/warehouse of the Seller, being the means chosen by the Buyer when ordering the selected products. The risk of accidental loss or damage to the goods passes to the Buyer upon receipt of the goods by the Buyer.
Delivery outside Portugal is made by courier or postal organization. The risk of accidental loss or damage to the goods shall pass from the Seller to the Buyer from the moment of delivery of the goods to the post office or postal organizations for their delivery.
The Seller undertakes to properly pack and label the goods. Packing and marking of goods must ensure their safety during transportation.
If the ordered products are in the Seller's stock for the required amount, the shipment will be made within 5 (five) working days from the date of payment.
If the order contains several products, where some of them are in stock and one of them is marked as that it will be shipped within a specific time period – the entire order will be shipped to the Buyer during the specified period of delay from the date of payment of the goods by Buyer, unless otherwise determined by Seller. If there are two or more "backordered" products in the order - the order shipping time will be determined by the longest one.
If the selected delivery method specified by Buyer in the region or country for any reason is not possible, Buyer and Seller determine another shipping method and cost.
If the carrier does not receive the goods, the Buyer bears the costs of returning the goods and, when necessary, pays for its re-presentation to the Buyer.
Average delivery time indicated by different mailing organizations or couriers:
• Mainland National WEPICKUP- 1-5 days
• WEPICKUP National Islands – 10-15 Days
• WEPICKUP - European countries up to 10 business days, other countries up to 18 business days.
• Store order - 0 days
Compensation for parcels is offered by the Seller or postal organizations (carriers), according to the delivery method chosen by the Buyer. Postal organizations (carriers) offer compensation on the following terms:
• All orders shipped via WEPICKUP are not cleared.
• All orders shipped by WEPICKUP with Insurance are compensated for a maximum of 100% of products ordered, excluding shipping costs.Buyers - natural persons who are not owners and who have the status of consumer within article 34 of the law of obligations of the Portuguese Republic have the right to return the goods to the Seller and terminate the sales contract, in accordance with art. 56 of the Law of Obligations of the Portuguese Republic, if for any reason it is necessary.
WARRANTY TERMS AND PROCEDURE FOR SUBMISSION OF CLAIMS, RIGHT TO REJECT CONTRACT
When returning the goods in accordance with clause 6.1. of these terms and conditions, this product must not be used and must be packed in the original packaging; the original packaging must not be substantially damaged, the Buyer must take all measures to limit damage to the packaging of the goods during the unpacking of the goods; merchandise must be fully personal; the product must bear the manufacturer's labeling, including the serial numbers of the goods.
Upon cancellation of the sales contract in accordance with clause 6.1. these terms and conditions, Buyer pays the cost of shipping the goods to Seller. Goods must be packed and labeled in such a way that they have not been damaged during transport.
Buyer shall promptly inform Seller of its wish to withdraw from the sales contract in accordance with clause. of these terms and conditions and for not more than within 14 days return the goods to the Seller. The product is considered returned upon receipt by the Seller.
Seller shall, within 30 days of receipt of the goods and their examination, return the purchase price paid by Buyer, unless Buyer and Seller agree otherwise.
Seller does not perform warranty repairs. In the event of a warranty case, Seller acts as an intermediary between Buyer and the product manufacturer or warranty repair shop.
The claim period for buyers - non-owner individuals, and having consumer status, is 24 months.
The warranty period for a product is determined by the manufacturer.
Seller is not responsible for:
Deterioration/damage to the product due to the fault of the buyers;
Deficiencies that appeared in the product in the course of irregular use;
Usual wear and tear of the goods as a result of normal use.
An invoice or proof of purchase for the Seller's products is the basis for making product warranty repair.
The warranty period begins to run from the date of receipt of the goods by the Purchaser.
In case of warranty, the Buyer must immediately notify the Seller, specify details and send to the Seller or to the Seller's service center a copy of the document confirming the purchase and delivery of the goods.
FORCE MAJEURE
The breach of an obligation is justified if one of the parties has breached an obligation by force majeure. Force majeure are circumstances that the party could not influence, and, based on the principle of reasonableness, the party could not be expected to recognize or prevent that fact, or to infringe the circumstance or prevent the consequences.
CONFLICT RESOLUTION PROCESS
All disputes associated with the fulfillment of these conditions, the ordering of goods from the online store and the delivery of the ordered goods will be resolved through negotiations. If no agreement is reached on the subject of the dispute by negotiation within 30 calendar days, the dispute will be submitted to the Court of the Portuguese Republic and will be dealt with under Portuguese law.
